If payment has already been collected for an order that we cancel, any applicable refund will be issued to the original payment method.

5.2 Freight Deliveries

Large and oversized products may be shipped by Less-Than-Truckload (LTL) freight. Customers receiving freight shipments are responsible for following the delivery inspection and Proof of Delivery procedures described in our Shipping Policy and Return and Refund Policy.

5.3 Delivery Information

You are responsible for providing an accurate delivery address and, when required for freight delivery, a working telephone number that the carrier can use to coordinate delivery.

6. Returns, Refunds, Cancellations, and Damage

Returns, refunds, order cancellations, refused deliveries, freight damage claims, replacement remedies, and applicable return costs are governed by our Return and Refund Policy.

Please review that policy before purchasing, particularly when ordering large or freight-delivered products.

To the maximum extent permitted by applicable law, our total liability arising from or relating to a product or order will not exceed the amount actually paid by you for the product giving rise to the claim.

Some states do not allow certain exclusions or limitations of liability. Accordingly, some of these limitations may not apply to you.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Homestead Harvest Supply, Legacy Creators LLC, and their affiliates, directors, employees, and agents from claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

  • Your violation of a third party's rights, including intellectual property or privacy rights.

13. Termination and Access

Termination or suspension of an account does not affect obligations arising from orders already placed or transactions completed before termination.

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

15. Disputes and Chargebacks

15.1 Informal Resolution

If a concern or dispute arises regarding an order, delivery, refund, product, or charge, please contact us first at hello@homesteadharvestsupply.com so we have an opportunity to review and attempt to resolve the issue.

15.2 Chargebacks and Payment Disputes

If a payment dispute or chargeback is filed, we reserve the right to contest the dispute and provide relevant transaction and fulfillment records to the payment processor, card issuer, bank, or other financial institution.

Supporting records may include order details, customer communications, shipping and tracking records, delivery records, photographs, and a signed Proof of Delivery (POD), where applicable.

15.3 Mediation and Arbitration

If a dispute cannot be resolved informally, the parties agree that the dispute will be settled through binding arbitration in accordance with the applicable rules of the American Arbitration Association, except where applicable law provides otherwise. Arbitration will take place in El Paso County, Colorado, unless the parties agree otherwise or applicable law requires a different location.

15.4 Individual Proceedings

To the extent permitted by applicable law, disputes will be resolved on an individual basis rather than as part of a class, consolidated, or representative proceeding.

15.5 Exceptions

Either party may bring an eligible claim in small claims court or seek appropriate injunctive relief relating to infringement or misuse of intellectual property rights.

16. Force Majeure

Homestead Harvest Supply will not be responsible for delays or failure to perform caused by events beyond our reasonable control, including carrier delays, severe weather, natural disasters, supplier production delays, transportation disruptions, labor disruptions, government actions, shortages, or other circumstances outside our reasonable control.

Where such an event affects an order or delivery, we will make reasonable efforts to communicate available information and continue performance when reasonably possible.

17. Changes to Terms

We reserve the right to modify or replace these Terms from time to time. Updated Terms will become effective when posted on the Website unless otherwise required by applicable law.

Your continued use of the Website after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law. Terms applicable to a completed transaction remain subject to applicable law and the terms in effect for that transaction.

18. Miscellaneous

18.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

18.2 Entire Agreement

These Terms, together with the policies referenced in them, constitute the agreement between you and Homestead Harvest Supply regarding your use of the Services and purchases from us, except where otherwise required by applicable law.

18.3 Waiver

Our failure to enforce a right or provision of these Terms will not constitute a waiver of that right or provision.
